Terms & Conditions – Ghartak Apps

Welcome to Ghartak. These Terms & Conditions govern your use of the Ghartak platform, including:

  • Ghartak User App

  • Ghartak Vendor App

  • Ghartak Delivery Partner App

By accessing or using any Ghartak service, you agree to comply with these Terms & Conditions.


1. Definitions

  • "Platform" refers to Ghartak applications, website, and services.

  • "User" refers to customers using the Ghartak User App.

  • "Vendor" refers to store owners or businesses using the Ghartak Vendor App.

  • "Delivery Partner" refers to individuals delivering orders through the Ghartak Delivery Partner App.

  • "Services" refers to ordering, delivery, payment, and related platform services provided by Ghartak.


2. Eligibility

To use Ghartak services:

  • You must be at least 18 years old.

  • You must provide accurate and complete information.

  • You are responsible for maintaining account confidentiality.

Ghartak reserves the right to suspend or terminate accounts that provide false information or violate these terms.


3. User Accounts

Users, Vendors, and Delivery Partners are responsible for:

  • Maintaining login credentials securely

  • All activity under their accounts

  • Updating profile and contact information when necessary

You must immediately notify Ghartak of any unauthorized account activity.


4. Orders & Deliveries

For Customers

  • Orders are subject to vendor availability.

  • Estimated delivery times are approximate.

  • Delays may occur due to traffic, weather, vendor issues, or unforeseen circumstances.

  • Customers must provide accurate delivery addresses and contact details.

For Vendors

  • Vendors are responsible for product quality, pricing, availability, and packaging.

  • Vendors must fulfill accepted orders within the expected preparation time.

  • Vendors must comply with applicable food safety and business regulations.

For Delivery Partners

  • Delivery Partners must handle orders responsibly and professionally.

  • Delivery Partners are responsible for timely pickup and delivery.

  • Misconduct, fraud, or repeated delivery failures may result in account suspension.


5. Payments & Refunds

Payments

Ghartak supports multiple payment methods, including:

  • Cash on Delivery (COD)

  • UPI

  • Debit/Credit Cards

  • Wallets and online payment services

All transactions must be completed through approved payment channels.

Refunds

Refund eligibility depends on:

  • Order cancellation status

  • Vendor approval

  • Delivery issues

  • Payment verification

Refund timelines may vary depending on payment providers and banking systems.


6. Wallet & Earnings

Vendors and Delivery Partners

  • Earnings, commissions, and wallet balances are visible within the app.

  • Withdrawal requests may require verification.

  • Ghartak reserves the right to hold payments in cases of disputes, fraud investigation, or policy violations.


7. Cancellations

Customer Cancellation

Orders may only be canceled before vendor acceptance or preparation, depending on platform rules.

Vendor Cancellation

Vendors should avoid unnecessary cancellations. Frequent cancellations may affect account performance.

Delivery Partner Cancellation

Delivery Partners should only cancel assigned deliveries for valid reasons.


8. Prohibited Activities

Users must not:

  • Use the platform for illegal activities

  • Submit false orders or fake information

  • Abuse, harass, or threaten other users

  • Attempt unauthorized access to systems

  • Interfere with platform operations

  • Upload harmful software or malicious content

  • Misuse promotions, discounts, or referral systems

Violation of these rules may result in account suspension or permanent termination.


9. Intellectual Property

All Ghartak content, including:

  • Logos

  • Branding

  • App design

  • Graphics

  • Software

  • Text and content

is the property of Ghartak and protected under applicable intellectual property laws.

Unauthorized use or reproduction is prohibited.


10. Third-Party Services

Ghartak may integrate with third-party services including:

  • Payment gateways

  • Maps and navigation providers

  • SMS and notification services

  • Analytics providers

Ghartak is not responsible for issues arising from third-party services.


11. Limitation of Liability

Ghartak provides the platform on an “as available” basis.

We are not liable for:

  • Delivery delays

  • Product quality issues from vendors

  • Temporary service interruptions

  • Technical errors or downtime

  • Losses caused by third-party services

  • Indirect or consequential damages

Users agree to use the platform at their own risk.


12. Account Suspension & Termination

Ghartak reserves the right to suspend or terminate accounts for:

  • Violation of these Terms

  • Fraudulent activity

  • Abuse or misconduct

  • Repeated cancellations or complaints

  • Legal or regulatory reasons


13. Privacy

Your use of Ghartak services is also governed by our Privacy Policy.

By using the platform, you agree to the collection and use of information as described in the Privacy Policy.


14. Changes to Terms

Ghartak may modify these Terms & Conditions at any time.
